Understanding the NLRB's New Burden-Shifting Standard for Employer Work Rules and Employee Handbooks

In Stericycle, Inc., the National Labor Relations Board (NLRB) upended the standard for evaluating whether a work rule infringes upon employees' rights under Section 7 of the National Labor Relations Act and adopted a new burden-shifting standard that turns on whether a work rule could reasonably be interpreted to chill employees' Section 7 activity. The ruling could spur the NLRB General Counsel and employees to bring more unfair labor practice challenges to employer work rules and employee handbooks. This webinar will offer key takeaways for employers—both unionized and non-union—to consider in amending or drafting new rules and employee handbooks in light of the NLRB's new standard.
